1. Website https://www.metafleet.be and scope of these Terms of Use

1.1 The website https://www.metafleet.be (the " Website ") is owned by Mobile Systems Europe srl, a company incorporated under Belgian law, with registered office at 1030 Schaerbeek, Rue des Palais, 44/52 and registered with the ECB under company number 0879.633.414, info@mseurope.be, (" Mobile Systems Europe ").

The Site is operated and hosted by OVH, a SAS company under French law, whose registered office is located at 2 rue Kellermann - 59100 Roubaix - France and registered in Lille Métropole under the company number 424 761 419 00045.

1.2 Only the visitor's use of the Site is governed by these Terms of Use.

 

2. Content of the Site

2.1 The Site provides information on Mobile Systems Europe (location of installers, information on Mobile Systems Europe, guarantees, contact details, ...) and on the products and services it offers, mainly in the field of on-board electronics (e.g. Track & Tracing (fleet management), vehicle theft protection systems, parking assistance systems, and a range of more comfort-oriented products, ...). The products and services presented on the Site are for information purposes only and can in no way be considered as a firm and definitive offer from Mobile Systems Europe. All transactions concerning the products and services presented on the Site are subject to a separate contract and to specific conditions, which are available for consultation here.

2.3 Mobile Systems Europe makes every effort to ensure that the content of the Site is complete, correct and up-to-date. Despite its efforts, it is possible that some information is incomplete, incorrect or outdated. Mobile Systems Europe does not guarantee the accuracy of the content and information on the Site.

2.5 The Site is available in French and Dutch.

 

3. Use of the Site

3.1 The Site is freely available to all visitors. Use of the Site is permitted only in accordance with these Terms of Use, which include the Privacy Policy and the Cookie Policy.

3.2 By using the Site, the visitor is presumed to have read and accepted these Terms of Use in their entirety. If the visitor does not agree to the provisions of these Terms of Use, he or she is invited to leave the Site.

Third party websites and their content are the sole responsibility of their author(s).

4.3 Mobile Systems Europe commits itself to delete the links of which it acquires effective knowledge that they lead to illegal information or activity.

5.2 Unless otherwise stipulated, the textual or numerical information appearing on the Site may be used free of charge, provided that the source is mentioned and only for a use that is neither commercial nor advertising (e.g. informative, scientific, educational, private use, etc.). 6. Limitation and exclusion of liability

6.1 To the extent permitted by law, Mobile Systems Europe:

  • declines all responsibility for any damage resulting from the direct or indirect use of its Site by the visitor;
  • declines all responsibility for any damage resulting from decisions taken by the visitor on the basis of the consultation of the Site, the consultation and use of the information contained therein being exclusively at the visitor's risk;
  • does not guarantee the proper functioning of the Site and declines all responsibility in the event of malfunction or unavailability of the Site;

9.1 Mobile Systems Europe reserves the right to adapt, modify or complete the content of the Site at its own discretion and without prior notification.

9.2 Mobile Systems Europe reserves the right to modify or complete the present Terms of Use of the Site at any time.

In the event of any inconsistency between the provisions of the above Policies and these Terms of Use, these Terms of Use shall prevail.

 

10. Divisibility

10.1 If any provision of these Terms of Use should be declared invalid or unenforceable, the remaining provisions of these Terms of Use shall remain valid and enforceable and the inapplicable or illegal provision shall be replaced by an applicable or legal provision that best expresses the original intention of Mobile Systems Europe.

11.1 The non-application of one or more provisions of these Terms of Use by Mobile Systems Europe can never be considered by the visitor as a waiver of the present Terms of Use.

 

12. Applicable law and competent courts

12.1 By using the Site, the visitor agrees that the formation, performance and interpretation of these Terms of Use, including the Privacy Policy and the Cookie Policy, shall be governed exclusively by and construed in accordance with Belgian law, without prejudice to the right of consumers residing outside Belgium to rely on the mandatory provisions of their national law.

12.2 Any dispute relating to the use or content of the Site and/or the formation, performance and interpretation of the Terms of Use of the Site, including the Privacy Policy and the Cookie Policy, shall be settled exclusively by the courts of Brussels, without prejudice to the right of consumers to avail themselves of the provisions of Regulation (EU) No. 1215/2012 of the European Parliament and of the Council of 12 December 2012 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters
